Co-ownership of a vehicle by an IndianFootnote 1 and a non-Indian
This article outlines the conditions required to be met for relief of the GST/HST to apply when a vehicle is purchased by an Indian and a non-Indian. The conditions outlined in this article do not represent a change in the Canada Revenue Agency’s (CRA) policy. The information is being provided in order to ensure that the conditions for obtaining relief are clear and readily available. This article does not discuss leases, licences and similar arrangements.
Section 87 of the Indian Act exempts from tax the personal property of an Indian or an Indian band situated on a reserve. The CRA is responsible for administering the Excise Tax Act, which governs the application of the GST/HST. Technical Information Bulletin B-039, GST/HST Administrative Policy – Application of the GST/HST to Indians, summarizes the CRA’s policy concerning the application of the GST/HST to supplies of property and services made to Indians, Indian bands and band-empowered entities.
Under the CRA’s policy, GST/HST relief applies to goods, including vehicles, purchased by an Indian when the goods are either purchased on a reserve or are delivered to a reserve by the vendor or the vendor’s agent. When an Indian purchases goods, vendors must keep supporting documents as proof that the sale was made to an Indian and, if applicable, that the goods were delivered to a reserve. The CRA will accept a Certificate of Indian Status or a Temporary Confirmation of Registration Document as proof that an individual is registered under the Indian Act.
Generally, when a vehicle is purchased by an Indian and a non-Indian, the relief of the GST/HST will apply if the following conditions are met:
- the Indian and the non-Indian purchase the vehicle as co-owners and are jointly and severally, or solidarily liable for the cost of the vehicle
- the Indian shows proof of their status to the vendor
- if the vehicle is purchased off-reserve, the vendor delivers the vehicle to a reserve and maintains evidence of delivery
The purchasers will be both jointly and severally, or solidarily liable where both names appear on the bill of sale or other similar document. It is a question of fact as to who is the purchaser of the vehicle, as well as where the delivery of the vehicle was made.

In Ontario, registrant vendors may credit eligible Indian purchasers at the time of sale with an amount equal to the 8% provincial part of the HST for qualifying off-reserve supplies of vehicles. Incidental sellers of insurance
This article addresses changes to the GST/HST treatment applied to supplies made by incidental sellers to insurers.
For the purposes of this article, the term incidental seller is used to refer to a person who assists the insurer in the issuance of insurance but whose principal business is normally carried on outside the insurance industry (such as retailers, automotive dealers, banks, travel agents). For example, while supplying travel services to a customer, a travel agent may also facilitate the issuance of travel insurance from an insurer to a customer. If an incidental seller is considered to be arranging for an exempt supply of insurance by an insurer, the supply of this service by the incidental seller to the insurer will generally be an exempt supply of a financial service.
An incidental seller’s service supplied to the insurer would typically include promoting the insurance, assisting the incidental seller’s customer in understanding and obtaining the insurance from the insurer, and collecting the premium from the customer and sending it to the insurer.
Previously, the CRA viewed these supplies made by incidental sellers as taxable supplies on the basis that the predominant element of each supply was that of a promotional and administrative service. The Tax Court of Canada rendered decisions in Applewood Holdings Inc. v. The Queen, 2018 TCC 231 and Zomaron Inc. v. The Queen, 2020 TCC 35. For more information on the Applewood decision, refer to the article on this topic in the Excise and GST/HST News No. 106. The CRA will apply principles from these decisions to an incidental seller’s supply of services of arranging for the supply of insurance to an insurer.
Where the essential character of the service for which an incidental seller earns its fees is the sale of insurance on behalf of the insurer to the customer, it will generally be considered an exempt supply of a financial service. In such circumstances, the supply by the incidental seller is arranging for the issuance of a financial instrument (such as, an insurance policy).
There may be circumstances where an incidental seller is doing more than arranging for the supply of insurance. In those cases, it will be a question of fact whether the supply may be something other than an exempt supply of a financial service.
Digital economy
Budget 2021 proposed to amend the Excise Tax Act by confirming previously announced GST/HST measures that related to the digital economy. These amendments were included in Bill C‑30 (Budget Implementation Act, 2021, No. 1), which received Royal Assent on June 29, 2021. As a result, the GST/HST measures relating to the digital economy became law, effective July 1, 2021.
As discussed in the Excise and GST/HST NewsNo. 109, affected businesses and platform operators are expected to comply with their obligations to register, collect and remit the GST/HST as set out under the new rules and legislative provisions to ensure that the GST/HST applies effectively and fairly to e-commerce transactions. As announced in Budget 2021, the CRA will work closely with affected businesses and operators to assist them in meeting their obligations. Where such businesses and operators show that they have taken reasonable measures but are unable to meet their new obligations for operational reasons, the CRA will take a practical approach to compliance and exercise discretion in administering the measures during a 12‑month transition period, starting July 1, 2021.
Before the CRA exercises its discretion in the administration of the new measures, an affected business or platform operator must first obtain the CRA’s written approval that such discretion will be exercised. Submissions for the exercise of discretion may be made to the CRA during the 12-month transition period.
To receive a timely response from the CRA regarding the exercise of its discretion, a submission from an affected business or platform operator should provide as much information as possible to demonstrate why it is unable to meet, for operational reasons, its new GST/HST obligations despite taking reasonable measures to try to be compliant. Submissions should therefore briefly describe:
- the activities of the affected business or operator, along with estimated annual sales figures in Canada and the GST/HST normally collected,
- the issues encountered by the affected business or operator,
- the steps to be taken to resolve those issues and their anticipated completion dates, and
- any extenuating circumstances that may prevent the business or operator from being compliant with the new GST/HST measures before a specified date.
Note that because this is not intended to be an exhaustive list, the CRA may contact the affected business or operator if additional information is required in respect of their submission.
A submission should also indicate how long the affected business or platform operator needs the CRA to exercise its discretion by providing a specific end date that does not extend beyond June 30, 2022.

Prescribed rates of interest
The prescribed annual rate of interest in effect from October 1, 2021 to December 31, 2021 on overdue amounts payable to the Minister is 5%. The prescribed annual rate of interest on amounts owed by the Minister (such as, rebates or refunds) is 1% for corporate taxpayers and 3% for non-corporate taxpayers. These rates are applicable to income tax, excise tax, GST/HST, the air travellers security charge (ATSC), the fuel charge (under the Greenhouse Gas Pollution Pricing Act) and excise duty on wine, spirits, tobacco and cannabis.
The prescribed annual rate of interest respecting excise duty on beer, on overdue amounts payable for the indicated period, is set at 3%. Refund interest rates are not applicable for amounts owed by the Minister (such as, rebates or refunds) for excise duty that is in relation to beer.
