The fairness monitor (FM) hereby provides the unqualified assurance statement below concerning the Remotely Piloted Aircraft System (RPAS) procurement process up to and including the conclusion of the finalization phase.

It is our professional opinion that the process we observed or monitored was carried out in a fair, open and transparent manner.

Project requirement

Samson was engaged on November 25, 2016 as an FM to observe the procurement process for the RPAS, formerly known as the Joint Unmanned Surveillance and Target Acquisition System, issued by Public Works and Government Services Canada (PWGSC) on behalf of the Department of National Defence (DND) under solicitations 660BL-120002/B to E and solicitations W847A-190247/A to D. Samson is an independent third party with respect to this activity.

This report covers the activities of the FM starting with the request for information (RFI) until the close of the finalization phase of the request for proposal (RFP) on December 15, 2023.

As part of the Canada First Defence Strategy, DND has a need to identify options to field and support interoperable, network-enabled unmanned aircraft systems (UAS) to provide intelligence, surveillance, reconnaissance, target acquisition, and all-weather precision strike capabilities in support of the Canadian Armed Forces (CAF) operations worldwide. The objective of this project is to procure and field a long endurance unmanned aircraft system to provide these mandatory capabilities for domestic and international operations.

We reviewed all the information provided and observed all relevant activities subsequent to our engagement.

Fairness monitoring engagement and observations

In accordance with the terms of our engagement, we:

In this section

Request for information phase

The RFI was posted on Buyandsell.gc.ca (660BL-120002/B) on January 15, 2016, and it closed on April 15, 2016. The RFI provided an opportunity for Canada to determine suppliers interest for the requirement, and for suppliers to provide comments regarding long range, long endurance UAS.

Four amendments were posted on Buyandsell.gc.ca, the last of which was on March 15, 2016. Questions from suppliers were accepted and answers were provided and distributed on Buyandsell.gc.ca.

Fifteen responses to the RFI were submitted by suppliers. One supplier who did not submit an RFI response requested a meeting with the RPAS team to present their data processing and analysis capability. In total, 9 suppliers participated in one-on-one sessions.

On January 22, 2018, a first set of follow-up questions was sent to 3 suppliers. On December 17, 2018, a second set of follow-up questions was sent to 2 suppliers who presented their answers in one-on-one meetings which took place on January 25 and February 26, 2019.

The FM attended the one-on-one meetings and reviewed the RFI document, follow-up questions, as well as questions received from suppliers and answers provided during the RFI posting period to ensure that fairness considerations were satisfactorily addressed.

No fairness issues were identified.

Request for information: Update phase

The update to the RFI was posted on Buyandsell.gc.ca (660BL-120002/C) on July 6, 2016, and it closed on April 12, 2019. The update to the RFI ensured that all suppliers had the same information following the latest one-on-one sessions, and that a line of communication with interested suppliers remained open. This notice was used to provide updates such as project's name change, links to announcements by the CAF, etc.

Five notice amendments to the update to the RFI were published on Buyandsell.gc.ca, with the last one being on April 8, 2019.

The FM reviewed the update to the RFI and amendments to ensure that fairness considerations were satisfactorily addressed.

No fairness issues were identified.

Supplement to the request for information: Update

A supplement to the RFI update was posted on Buyandsell.gc.ca (660BL-120002/D) on December 17, 2018, and it closed on April 12, 2019. The supplement to the RFI update informed industry that, in support of the efforts to develop the RPAS project's sustainment requirements and approach, sustainment-related questions had been drafted for written responses to be provided by February 15, 2019.

One amendment was posted on Buyandsell.gc.ca on April 8, 2019. No responses were received from industry.

The FM reviewed the supplement to the RFI update and the related amendment to ensure that fairness considerations were satisfactorily addressed.

No fairness issues were identified.

Draft invitation to qualify phase

The draft ITQ was posted on Buyandsell.gc.ca (W847A-190247/A) on April 5, 2019, and it closed on April 23, 2019. The draft ITQ provided the opportunity for interested suppliers to submit their written feedback by April 23, 2019, before Canada released the final ITQ to be used to pre-qualify suppliers.

Eight respondents provided comments on the draft ITQ.

The FM reviewed the draft ITQ as well as the feedback and questions received from suppliers to ensure that fairness considerations were satisfactorily addressed.

No fairness issues were identified.

Invitation to qualify phase

The ITQ was posted on Buyandsell.gc.ca (W847A-190247/B) on May 2, 2019, and it closed on May 16, 2019. The ITQ was deemed to be the first phase of the procurement process for the RPAS project and was meant to invite suppliers to pre-qualify.

One amendment was posted on Buyandsell.gc.ca on May 14, 2019. Questions from potential suppliers were accepted and answers were provided and distributed on Buyandsell.gc.ca.

Five suppliers submitted responses on the ITQ. Evaluation guidelines and an evaluation grid were developed in alignment with the qualification requirements as per annex A of the ITQ. The technical evaluation team was composed of 4 evaluators. A consensus evaluation meeting took place on May 17, 2019. A consensus was achieved on the qualification requirements that were evaluated during the meeting. Two suppliers were deemed compliant with the qualification requirements.

An opportunity to provide additional information was provided to 3 suppliers, as permitted by clause 3.2 note 3 of the ITQ. A second consensus meeting took place on May 28, 2019 to review responses and new information provided by suppliers. A consensus was achieved on the qualification requirements, and all 3 suppliers were deemed non-compliant with the qualification requirements.

The FM reviewed the ITQ, as well as all questions and answers provided during the ITQ posting period. The FM also reviewed the evaluation guidelines and the evaluation grid and attended the consensus meetings to ensure that fairness considerations were satisfactorily addressed.

No fairness issues were identified.

Invitation to qualify: List of qualified suppliers

A letter of interest (LOI) - RFI was posted on Buyandsell.gc.ca (W847A-190247/C) on May 30, 2019 to provide the names of the 2 qualified suppliers. The LOI - RFI closed on June 1, 2022.

Although the LOI - RFI indicated that Canada could, at its sole discretion, re-open the ITQ, it has not occurred. The LOI - RFI is also used to update the list of consulting firms engaged by Canada during the procurement process.

Four amendments were posted on Buyandsell.gc.ca, with the last one being on June 1, 2022. The first 3 amendments provided the names of consulting firms engaged that may have been involved in the preparation and review of the solicitation documents or may have had access to solicitation documents in performing their tasks. During the RFP phase, more specifically on May 20, 2022, PWGSC was advised by 1 of the qualified suppliers that they have elected not to bid. The fourth amendment was to indicate the withdrawal of this qualified supplier.

The FM reviewed the LOI - RFI and amendments to ensure that fairness considerations were satisfactorily addressed.

No fairness issues were identified.

Review and refine requirements phase

The RRR phase started on July 10, 2019. Emails were sent to the 2 qualified suppliers with an RRR document to share information and obtain feedback from qualified suppliers on Canada's preliminary requirements, the notional procurement process, and on subsequent phases of the procurement.

One amendment was sent to the qualified suppliers on April 23, 2021 to replace some articles of the RRR document and add new ones. Numerous activities took place during the RRR phase as further detailed below.

Activities prior to the initial draft request for proposal release

Kick-off meetings

A conference call with each qualified supplier took place in July 2019 to discuss upcoming RRR activities and topics of interest.

Clarification questions were sent to the qualified suppliers as required between March 25, 2020 and August 10, 2020 in relation to a document they had provided.

Document submission

The statement of operating intent was provided to the qualified suppliers on January 28, 2020, for discussion at one-on-one sessions that took place in February 2020.

On May 25, 2020, the security acceptability assessment (SAA) section of the draft RFP was submitted to the qualified suppliers for comments. On June 29, 2020, a document named proposal, resulting instruments and bidders was submitted to the qualified suppliers for comments.

Training and site visits

A training session was provided to the qualified suppliers from October 28 to 30, 2019, followed by separate one-on-one sessions with the qualified suppliers on October 31, 2019. The FM was present during those sessions.

Visits at the 2 qualified suppliers' premises took place in January 2020. The contracting authority (CA) and FM were present during these visits.

One-on-one sessions, conference calls and webinar

One-on-one sessions took place in February 2020, with guiding questions on several topics provided to the qualified suppliers in advance of the meetings. Action items resulting from the February 2020 one-on-one sessions were provided to the qualified suppliers.

One-on-one virtual meetings took place with the qualified suppliers in May 2020 to discuss:

  • the project economic benefits
  • the industrial and technological benefits (ITB) policy
  • the value proposition (VP)
  • etc.

On June 12, 2020, a conference call took place with 1 qualified supplier to discuss some follow-up questions following the January 2020 visit, the proposed timelines, and the procurement instruments. On June 18, 2020, a conference call took place with the manufacturer proposed by 1 qualified supplier and the manufacturer's government to mainly discuss the proposed timelines and the procurement instruments. On June 30, 2020, a follow-up call took place to provide further clarification on the procurement instruments.

One-on-one virtual meetings took place with the qualified suppliers in June and July 2020 to discuss certification and other aspects. Additional information was provided to both qualified suppliers on September 25, 2020 as a follow-up on the sessions.

On June 15 ,2020, an LOI (660BL-120002/E) was posted on Buyandsell.gc.ca to indicate that Unmanned Systems Canada would host a webinar to provide a brief to Canadian industry and other stakeholders on the RPAS project, including an overview of the:

  • project requirements
  • procurement process
  • project timelines

The webinar hosted by Unmanned Systems Canada took place with both qualified suppliers on June 22, 2020 to brief them on the RPAS program and allow them to make a presentation of their:

  • company
  • supplier team
  • focus areas
  • contact information

An amendment was issued on June 23, 2020 to provide industry with the presentation. The LOI closed on June 11, 2021.

One-on-one virtual meetings took place with the qualified suppliers in September 2020 to discuss the draft SAA, training, and other topics as deemed necessary.

One-on-one virtual meetings took place with the qualified suppliers in November 2020 to discuss the VP/ITB evaluation strategy.

Initial draft request for proposal release and following activities

Initial draft request for proposal submission

Most sections of the draft RFP were submitted to the qualified suppliers on November 16, 2020 for their comments. Some others were released on:

Some revised RFP sections were sent out to the qualified suppliers on:

On January 14, 2021, February 1, 2021 and June 25, 2021, a clarification statement was sent to the qualified suppliers to provide clarification on some RFP aspects. On June 1, 2021, an update on the release of the RFP was sent to the qualified suppliers. On June 11, 2021, a clarification was provided to both qualified suppliers in relation to the format to use to submit information requested under the RFP attachment 2C-3-1.

Feedback from qualified suppliers and one-on-one sessions

On several occasions, both qualified suppliers provided the CA with feedback on the draft RFP documents. In addition, several virtual meetings took place to discuss various aspects of the RFP documents.

One-on-one virtual meetings took place with the qualified suppliers in February 2021 to discuss the life-cycle cost evaluation. Relevant information for the meeting discussions were provided to the qualified suppliers on February 6, 2021.

One-on-one virtual meetings took place with the qualified suppliers in February and March 2021 to discuss the VP/ITB evaluation strategy.

At the request of 1 qualified supplier, virtual meetings took place to discuss several aspects of the draft RFP:

  • January 25, 2021: Training and simulation
  • January 29, 2021: Air worthiness
  • February 12, 2021: VP/ITB terms and conditions
  • February 22, 2021: RFP terms and conditions
  • February 26, 2021: Technical, sustainment and air worthiness requirements
  • April 9, 2021: Fleet sizing

At the request of the other qualified supplier, virtual meetings took place to discuss several aspects of the draft RFP:

On July 29, 2021, PWGSC sent a letter to the qualified supplier addressing their comments raised on February 19, 2021 regarding specific mandatory requirements which were discussed at the June 16, 2021 meeting.

Questions

On February 1, 2021, questions were sent to the qualified suppliers with respect to the maintenance of the remotely piloted aircraft. On February 1, 2021, a question was sent to the qualified suppliers to have their thoughts on the feasibility of combining the Avionic Systems (AVS) Technicians (Techs) and Aviation Systems (AVN) Techs roles to be performed by 1 common RPAS technician.

On March 11, 2021, questions were sent to the qualified suppliers with respect to the cold weather capability. On May 7, 2021, a question was sent to the qualified suppliers with respect to the use of a specific software for RFP purposes.

On June 11, 2021, a question was sent to the qualified suppliers with respect to their hangar and ramp requirements to plan for the conduct of the cold weather evaluation. On July 19, 2021, follow-up questions were sent to the qualified suppliers with respect to cold weather capability.

Full draft request for proposal release and following activities

Full draft request for proposal submission

A full draft RFP was submitted to the qualified suppliers on August 11, 2021 for their review and comments. It included recent changes made to some draft RFP sections the qualified suppliers had previously reviewed.

Following the release of the full draft RFP, new RFP sections were submitted to the qualified suppliers for comments on:

  • September 3 and 15, 2020
  • October 29 and 30, 2021
  • November 1 and 22, 2021
  • February 4, 2022

Some revised RFP sections were sent out to the qualified suppliers for comments on:

  • November 22, 2021
  • December 14, 21 and 22, 2021
  • February 2, 2022

On September 8, 2021 and October 7 and 27, 2021, a clarification statement was sent to the qualified suppliers to provide clarification on some RFP aspects.

Questions

On September 10, 2021, follow-up questions were sent to the qualified suppliers with respect to their cold weather capability. On February 4, 2022, questions were sent to the qualified suppliers regarding their security offer.

Feedback from qualified suppliers and one-on-one sessions

On several occasions, the qualified suppliers provided the CA with feedback on the full draft RFP documents. On October 12, 2021, PWGSC sent a letter to 1 qualified supplier addressing their comments on specific mandatory requirements detailed in their letter dated September 2, 2021. On February 9, 2022, PWGSC replied to the January 17, 2022 letter sent by 1 qualified supplier regarding comments on the capability delivery risk evaluation.

In addition, several virtual meetings took place to discuss various aspects of the RFP documents.

One-on-one virtual meetings took place with the qualified suppliers in August and September 2021 to discuss the revised version of the VP/ITB evaluation criteria.

One-on-one virtual meetings took place with the qualified suppliers in October 2021 to discuss the life cycle cost evaluation. Some other aspects of the draft RFP were also discussed at the meetings at the request of the qualified suppliers.

One-on-one virtual meetings took place with the qualified suppliers on November 15, 2021 to discuss the Indigenous Participation Plan. On December 1, 2021, a meeting took place at the request of 1 qualified supplier to further discuss the Indigenous Participation Plan.

On November 22, 2021, a message was sent to qualified suppliers requesting their feedback on annex 2H: Economic impact assessment. One-on-one virtual meetings took place with the qualified suppliers in December 2021 to discuss their feedback on the annex 2H: Economic impact assessment.

One-on-one virtual meetings with airport authorities took place with the qualified suppliers in January 2022 following the cancellation of the cold weather validation site survey as further detailed below.

Updates

On September 9, 2021, the qualified suppliers were advised that the formal RFP would not be released before late fall 2021.

On September 24, 2021, an update was sent to the qualified suppliers regarding the cold weather evaluation, indicating that they would be required to undergo the cold weather validation before the resulting instruments could be signed, and no later than the end of March 2023. On October 19, 2021, the qualified suppliers were advised that the cold weather validation site survey timing would take place the week of January 24, 2022.

On December 13, 2021, the qualified suppliers were advised not to expect the issuance of the formal RFP before mid January 2022.

On January 5, 2022, the qualified suppliers were advised of the decision to postpone the site visit physical portion of the cold weather validation site survey scheduled for the week of January 24, 2022 due to the current COVID situation. On January 13, 2022, the qualified suppliers were advised that sessions would be set up to provide an opportunity for the qualified suppliers to ask questions and receive as much information as possible in advance of completing the physical portion of the site survey.

On January 28, 2022, the qualified suppliers were asked to reconfirm their desire to conduct an on-site survey at Yellowknife airport and confirm their availability on proposed dates.

Fairness monitoring during the review and refine requirements phase

To ensure that fairness considerations were satisfactorily addressed, the FM:

    • formal RFP that was sent to the qualified suppliers at the close of the RRR phase

No fairness issues were identified.

The RRR phase closed on February 11, 2022, following the issuance of the formal RFP.

Request for proposal phase

The RFP (W847A-190247/D) was sent to both qualified suppliers on February 11, 2022 and had a closing date of August 11, 2022. Nine notices relating to the cold weather evaluation were issued, the last of which was on August 2, 2022. Eight amendments were issued, the last of which was on July 27, 2022. Questions from qualified suppliers were accepted and answers were provided through the amendments.

Both qualified suppliers attended the on-site survey at Yellowknife airport in April 2022. In accordance with article 15 of the RFP annex 2A, both qualified suppliers submitted on April 12, 2022, a first security offer in response to the requirements identified in appendix 2C-4: Security acceptability assessment.

The security assessment team assessed whether the offer was acceptable or not. The security assessment team was composed of 4 evaluators and 1 secretary/coordinator. The team was assisted by 4 security subject matter expert teams. The evaluation began on April 14, 2022, and consensus meetings took place on May 13, 2022, and June 6, 2022.

As indicated in section Invitation to qualify: List of qualified suppliers of this report, 1 qualified supplier advised PWGSC on May 20, 2022, that they have elected not to bid. Therefore, the assessment results were only sent to the remaining qualified supplier on June 13, 2022.

A request for further information was sent to the remaining qualified supplier on June 14, 2022. A meeting took place on July 27, 2022, with the qualified supplier to discuss matters relating to the cold weather evaluation.

The FM reviewed the RFP documents, as well as all questions and answers provided during the RFP posting period, to ensure that fairness considerations were satisfactorily addressed. The FM attended the on-site survey at Yellowknife airport. The FM attended the consensus meetings with the security assessment team, as well as the meeting with the qualified supplier.

No fairness issues were identified.

Evaluation phase of the request for proposal

A proposal evaluation governance structure document was prepared that defined the organizational structure of the evaluation governance bodies, their membership and their roles and responsibilities in managing the evaluation phase of the RFP. In addition, a proposal evaluation management plan was developed that described the management and administrative conduct of the evaluation and assessment of the proposals. The latter described in detail how each evaluation and assessment would be performed.

Oversight bodies included:

  • an executive governance committee
  • an evaluation management committee
  • an evaluation review board
  • a PWGSC management team

Each evaluation team consisted of 3 evaluators and was assigned:

  • an evaluation manager
  • a deputy evaluation manager
  • a team leader

Expert advisors assisted the evaluators as needed.

All evaluators, and those involved in the evaluations in a supporting role, were asked to complete the following required training prior before the start of their evaluations:

  • general evaluation training
  • RPAS specific training
  • evaluation specific training

The evaluation, assessment and review phase of the proposal started on August 16, 2022. Consensus meetings related to the following:

  • capability evaluations, including the second security acceptability assessment
  • life cycle cost evaluation
  • VP evaluation

The consensus meetings took place during the period from August 26 to October 27, 2022. The mission performance evaluation conformity check took place on September 1, 2022, and the life cycle cost conformity check took place on September 15, 2022. The first economic impact assessment briefing was conducted on September 27, 2022. The second security acceptability assessment took place on October 14, 2022, and the second security offer was deemed acceptable. A compliance assessment report (CAR) was sent on November 1, 2022, advising the qualified supplier of their compliance with all the RFP mandatory requirements.

Seven notices relating to the cold weather validation were issued, the last of which was on January 10, 2023. A virtual meeting took place on October 4, 2022, to discuss the cold weather validation. Virtual coordination meetings took place on December 15, 2022, and January 27, 2023 to discuss the upcoming cold weather validation with the qualified supplier.

In preparation for the finalization phase, requests for further information were sent to the qualified supplier on October 20, 2022, and November 7, 2022. Notices were sent to the qualified supplier on December 14 and 23, 2022 regarding an upcoming airworthiness familiarization training.

On January 13, 2023, a request was sent to the qualified supplier to extend the validity date of their proposal until the issuance of the resulting instruments; the request was approved. A virtual meeting took place on January 18, 2023, to discuss the upcoming finalization phase process.

The evaluation phase concluded on January 30, 2023, with the qualified supplier being informed that he has been invited to participate in the finalization phase of the solicitation process.

The FM reviewed the:

  • governance structure
  • proposal evaluation management plan
  • RFP amendments
  • requests for further information and notices sent to the qualified supplier
  • CAR
  • letter advising the qualified supplier of the close of the evaluation phase
  • final evaluation report (the FM had access to all the evaluation records, including the evaluators' notes)

The FM observed:

  • all consensus meetings
  • the conformity checks
  • the first economic impact assessment briefing

No fairness issues were identified.

Finalization phase of the request for proposal

A virtual meeting took place on February 10, 2023 to discuss the expectations regarding the finalization phase and identify any elements of the RFP where clarifications or discussions may be required.

Several activities took place during the finalization phase, including numerous in-person working group meetings and virtual meetings to discuss and finalize the resulting instruments as further discussed below. On December 15, 2023, the finalization phase was deemed successful by Canada as it was determined that all the finalization phase requirements noted in the RFP were met.

In this section

Cold weather validation

The cold weather validation took place from January 30 to February 1, 2023. On February 27, 2023, the qualified supplier submitted the cold weather validation report as requested in the RFP. The validation objectives were successfully demonstrated.

Training

An air worthiness familiarization training took place from February 13 to 15, 2023 to facilitate the qualified supplier's understanding of Canada's airworthiness certification and accreditation processes.

Finalization notices

Several finalization notices were sent to the qualified supplier during the period from February to September 2023:

  • to share draft contractual documents for review and comments
  • articles of agreement
  • statement of work
  • annexes
  • appendices
  • request information and clarifications
  • provide answers to questions
  • etc.

Proposal extension

On April 4, 2023, PWGSC asked the qualified supplier to extend its proposal to December 31, 2023, and it was approved.

Clarification requests

A request for further information was sent to the qualified supplier on May 11, 2023 as a follow-up to finalization notice number 5. A request for information was sent to the qualified supplier on July 5, 2023 as a follow-up to finalization notice number 15 and 18. A request for information was sent to the qualified supplier on September 19, 2023 as a follow-up to finalization notice number 19.

On August 11, 2023, PWGSC provided responses to questions from the qualified supplier regarding air worthiness. On October 18, 2023, a request was made to the qualified supplier relating to RPAS publications and courseware. A request for information was sent to the qualified supplier on November 21, 2023 regarding infrastructure requirements. On November 30, 2023, an information request was sent to the qualified supplier along with comments on the integrated master schedule.

Revised draft contractual documents

Revised draft contractual documents (articles of agreement, annexes, appendices, etc.) were submitted to the qualified supplier during the period of September to November 2023 for review and comments.

On August 21, 2023, PWGSC provided a response regarding the qualified supplier's recommendations on the detachment and integrated test team facilities, including a related update to the statement of work.

Full draft contract

A first version of the full draft contract was submitted to the qualified supplier on November 27, 2023 for review and comments. Written comments and/or proposed revisions to the first draft contract were sent by the qualified supplier and PWGSC during the period from November 30, 2023 to December 8, 2023.

A second version of the full draft contract was submitted to the qualified supplier on December 11, 2023 for review and comments. A third version of the full draft contract was submitted to the qualified supplier on December 12, 2023 for review and comments. Written comments and/or proposed revisions were provided by the qualified supplier on December 13 and 14, 2023.

On December 15, 2023, a fourth and final version of the full draft contract was submitted to the qualified supplier.

In-person working group meetings

Several in-person meetings took place to discuss various aspects of the resulting instruments as detailed below.

An in-person meeting took place on April 14, 2023 to discuss:

  • roles and responsibilities
  • schedule alignment
  • data transfer
  • certification
  • etc.

On April 25 and 26, 2023, in-person working group meetings took place to discuss the statement of work and provide clarification on certain matters.

In-person working group meetings took place on June 6 and 7, 2023 to discuss several aspects, such as:

  • airworthiness
  • training
  • intellectual property

In-person working group meetings took place on September 6 and 7, 2023 to discuss several aspects, including:

  • the articles of agreement
  • the integrated master schedule
  • the Canadian government cataloguing configuration
  • etc.

In-person working group meetings took place on October 10 and 11, 2023 to discuss:

  • security
  • basis and method of payment
  • price related information

In-person working group meetings took place on November 15 and 16, 2023 to discuss:

  • the billing
  • the integrated master schedule
  • the training
  • the articles of agreement
  • etc.

Virtual meetings

Weekly check-in virtual meetings took place during the period of March 2, 2023 to September 14, 2023 to discuss any questions or clarifications on the finalization notices and other matters. In addition, several virtual meetings took place to discuss various aspects of the resulting instruments as discussed below.

The basis and method of payment and/or price related information were discussed during virtual meetings that took place on:

  • May 4 and 9, 2023
  • August 21, 24 and 31, 2023
  • September 13, 18 and 19, 2023
  • October 27, 2023

A virtual meeting took place on July 14, 2023 to discuss training and facility requirements. A virtual meeting took place on July 17, 2023 to clarify various topics, including:

  • costing
  • invoicing
  • option periods for sustainment services

A virtual meeting took place on August 10, 2023 to discuss detachment and the integrated test team. Virtual meetings took place on August 3, 15, 25 and 29, 2023 to discuss various aspects of the articles of agreement.

On October 24, 2023, a virtual meeting took place to discuss communication security and on-boarding related aspects. The integrated master plan and master schedule were discussed during a virtual meeting on November 1, 2023. Security provisions and requirements, network configurations and some other aspects were discussed during a virtual meeting held on November 29, 2023.

Discussions on the revised draft contractual documents (articles of agreement, annexes, appendices, etc.) took place on:

  • September 11, 12, 14, 26, 27, 28 and 29, 2023
  • October 3, 4, 19, 20, 25, 26, 27 and 30, 2023
  • November 1, 3, 6 and 30, 2023

Virtual meetings took place on September 20, 21, 22 and 25, 2023 for all parties to provide an update on several outstanding aspects.

Virtual meetings took place on November 30, 2023 and on December 1, 4, 6, 7 and 8, 2023 to discuss some aspects of the first version of the draft contract and other matters to finalize the resulting instruments.

Virtual meetings took place on December 11 and 12, 2023 to discuss the second version of the full draft contract. Virtual meetings took place on December 13, 14, 2023 to discuss the third version of the full draft contract. A virtual meeting took place on December 14, 2023 regarding the integrated master schedule. On December 15, 2023, a meeting took place to discuss next steps and the release of the fourth and final draft version of the contract.

Fairness monitoring during the finalization phase

The FM attended the cold weather validation and was present to all the meetings that took place during the finalization phase. The FM reviewed the:

  • finalization notices and related documents
  • requests for information and responses provided by the qualified supplier
  • answers to questions received from the qualified supplier
  • draft contractual documents (articles of agreement, annexes, appendices, etc.)
  • different versions of the full draft contract, as well as comments provided by both parties on these documents

No fairness issues were identified.

Addendum to the final report

January 16, 2024

Addendum to the final report dated December 30, 2023, concerning the RPAS.

This addendum covers the period following the conclusion of the finalization phase, including contract award and debriefings.

Fairness monitoring activities related to contract award and debriefings

The contract was awarded to the qualified supplier on December 18, 2023.

There were no debriefing requests after contract award.

The FM reviewed the contract award correspondence with the qualified supplier.

Attestation of assurance

The FM hereby provides the unqualified assurance statement below concerning the RPAS procurement process up to and including the conclusion of contract award and debriefing activities.

It is our professional opinion that the process that we observed or monitored was carried out in a fair, open and transparent manner.
