The grievor challenged the counselling and probation (C&P) order they received for distributing an inappropriate video in the workplace. According to the grievor, this remedial measure was not based on reliable evidence, but rather on contradictory witness testimonies.
The Initial Authority refused to grant the grievor redress, stating that several testimonies indicated that the grievor had shown an inappropriate video and that the C&P was part of the administrative measures at the disposal of the chain of command to remediate the grievor's inappropriate conduct.
The Committee received and reviewed the Military Police investigation report, including certain bystander statements. The Committee determined that, based on the balance of probability, the grievor demonstrated a conduct deficiency by providing access to an inappropriate video in the workplace. As a consequence of these actions, remedial measures are justified. Following a review of available provisions, the Committee determined the C&P to be appropriate, given the circumstances, and recommended that the Final Authority not grant the grievor redress.
