Enforcement Bulletins
This section provides information on violations of the Pest Control Products Act and its Regulations that have resulted in warnings, penalties, and/or convictions.
The Agriculture and Agri-Food Administrative Monetary Penalties (AMPS) Act provides a system of penalties and warnings for violations of several federal Acts including the Pest Control Products Act, which regulates pesticides. The AMPS Act allows Canadian pesticide regulatory officials to impose penalties without having to pursue formal prosecution. As a result of amendments to the Agriculture and Agri-Food Administrative Monetary Penalties Regulations Respecting the Pest Control Products Act and Regulations, the penalties have increased. The applicable penalty amount in case of a violation with a date of awareness on or after 12 December 2018 is provided for in Section 5 of the Agriculture and Agri-Food Administrative Monetary Penalties Regulations Respecting the Pest Control Products Act and Regulations.

Health Canada is responsible for the regulation of pesticides in Canada under the Pest Control Products Act. Each pesticide proposed for use in Canada is evaluated to determine if it meets Health Canada's standards for the protection of health and the environment, and whether the product is effective for its intended use. Pesticides that meet Health Canada's standards are registered for use.
The import, sale or use of unregistered pesticides in Canada is a violation of the Pest Control Products Act, as is using a pesticide in a manner other than directed on the product label. Health Canada verifies reports of illegal pesticides or misuse through its network of regional officers.
When purchasing a pesticide, consumers should verify that a pest control product number (PCP number) appears on the label. This number indicates that the pesticide has been registered by Health Canada. Consumers should carefully read, understand and follow label directions when using any pesticide, and pesticides must not be used for purposes other than indicated on the label.

2024
Nagoya Trading Ltd. dba Tokyo Beauty & Healthcare was fined $20,000 for distributing a pest control product not registered in Canada and failing to comply with an order.
[Richmond, British Columbia]
In October 2024, Health Canada issued two notices of violation with penalties totalling $20,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Nagoya Trading Ltd. dba Tokyo Beauty & Healthcare (Richmond, British Columbia). These notices were issued for the distribution of unregistered pest control products and for failing to comply with an order.
Health Canada determined that Nagoya Trading Ltd. dba Tokyo Beauty & Healthcare distributed unregistered pest control products by offering it for sale at their storefront. All pest control products must be registered with Health Canada before they can be distributed or sold in Canada. One of the unregistered pest control products for use in and around the house contained empenthrin, which is an unregistered active ingredient in Canada. Nagoya Trading Ltd. dba Tokyo Beauty & Healthcare also failed to comply with an order, by the deadline given by Health Canada. The distribution of unregistered pest control products and failing to comply with an order are violations of the Pest Control Products Act.
Cargill Limited was fined $60,000 for using a pest control product in a way that is inconsistent with the label directions and in a way that endangers human health or the environment.
[Sarnia, Ontario]
In October 2024, Health Canada issued six notices of violation with penalties totalling $60,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Cargill Limited (Sarnia, Ontario). These notices of violation were issued for the use of a pest control product in a way that is inconsistent with the label directions and in a way that endangers human health or the environment.
Health Canada determined that in May 2023, Cargill Limited conducted fumigations of bins at their Sarnia Grain Terminal on three separate occasions using a product in a way that was inconsistent with the label directions and could have endangered human health or the environment. In Canada, the use of a pest control product in a way that is inconsistent with the label directions and in a way that endangers human health or the environment are violations of the Pest Control Products Act.
Three Star Cash & Carry was fined $30,000 for distributing two pest control products not registered in Canada and failing to comply with an order.
[Toronto, Ontario]
In October 2024, Health Canada issued three notices of violation with penalties totalling $30,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Three Star Cash & Carry (Toronto, Ontario). These notices were issued for the distribution of two unregistered pest control products and for failing to comply with an order.
Health Canada determined that Three Star Cash & Carry continued to distribute unregistered pest control products by offering them for sale at their storefront, after previously receiving an order to cease distribution of unregistered products. All pest control products must be registered with Health Canada before they can be distributed or sold in Canada. The unregistered pest control products were ant baits containing borax and boric acid for use in and around the house. Three Star Cash & Carry also failed to comply with an order to stop distributing unregistered pest control products. The distribution of an unregistered pest control product and failing to comply with an order are violations of the Pest Control Products Act.
Versova Inc. was fined $10 000 for possession of an unregistered pest control product.
[Woodbridge, Ontario]
In August 2024, Health Canada issued a notice of violation with penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Versova, Inc., (Woodbridge, Ontario). This notice of violation was issued for the possession an unregistered pest control product.
Health Canada determined that Versova Inc. had in its possession 6962 units of an unregistered pest control product. All pest control products must be registered with Health Canada. The unregistered pest control product was “LaxmanRekhaa”, an insecticidal chalk containing cypermethrin. The possession of an unregistered pest control product is a violation of the Pest Control Products Act.
Bar V Farms Ltd. was fined $30,000 for using an unregistered pest control product and in a way that endangers human health or the environment, and for making a false or misleading statement to an inspector regarding the use of a pest control product.
[Strathmore, Alberta]
In June 2024, Health Canada issued 3 notices of violation with a total penalty of $30,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Bar V Farms Ltd. (Strathmore, Alberta). These notices were issued for the use of unregistered 2% Liquid Strychnine Concentrate and in a way that endangers human health or the environment and for making a false or misleading statement to an inspector regarding the use of a pest control product.
Health Canada determined that Bar V Farms Ltd. applied unregistered strychnine in June 2023, in a way that endangered the surrounding environment. In addition, Bar V Farms Ltd. gave false information about their use of strychnine. Use of an unregistered product and in a way the endangers human health or the environment, and making a false or misleading statement to an inspector are all violations of the Pest Control Products Act.
Traitement de Pelouse Gauvreau was fined $26,000 for importing an unregistered pest control product and for failing to comply with an order.
[Grenville, Quebec]
In June 2024, Health Canada issued 2 notices of violation with a total penalty of $26 000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Traitement de Pelouse Gauvreau (Grenville, Quebec). These notices were issued for the import of an unregistered pest control product and for failing to comply with an order.
Health Canada determined that Traitement de Pelouse Gauvreau imported an unregistered pest control product in April 2023, after previously receiving an order to cease import of unregistered pest control products in July 2022. Import of an unregistered product and failing to comply with an order are contraventions of the Pest Control Products Act.
10168652 Manitoba Ltd, operating as Donair Guys, was issued two warnings for the use of an unregistered pest control product and in a way that endangers human health or safety or the environment.
[Winnipeg, Manitoba]
In June 2024, Health Canada issued two notices of violation with warnings under the Agriculture and Agri-Food Administrative Monetary Penalties Act to 10168652 Manitoba Ltd, operating as Donair Guys (Winnipeg, Manitoba). These notices of violation were issued for the use of an unregistered pest control product and in a way that endangers human health or safety or the environment.
Health Canada determined that in July 2023, Donair Guys applied the unregistered pest control product "Greenleaf Powder Cockroach Killing Bait" containing fipronil in their restaurant, while the restaurant was still in operation. There are no products containing fipronil registered for use in Canada. In Canada, the use of an unregistered pest control product and in a way that endangers human health or safety or the environment are violations of the Pest Control Products Act.
Poulin's Pest Control was fined $10,000 for using a product in a way that is inconsistent with the label directions and was issued a warning for using a pest control product in a way that endangers human health and the environment.
[Winnipeg, Manitoba]
In June 2024, Health Canada issued one notice of violation with a penalty of $10,000 and one notice of violation with warning under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Poulin's Pest Control of Winnipeg, Manitoba. These notices were issued for the use of a rodenticide pest control product in a way that is inconsistent with the directions on the label and in a way that endangers human health and environment.
Health Canada determined that Poulin's Pest Control applied a rodenticide in August 2023, not in accordance with the label directions which posed a risk to human health and the environment. Using a product contrary to the label directions and in a way that endangers human health and the environment are violations of the Pest Control Products Act.
Acuity Holdings, Inc. was fined $26,000 for distribution of a pest control product not packaged and labelled in accordance with its conditions of registration, and for the manufacture and distribution of unregistered pest control products.
[Vaughan, Ontario and Edmonton, Alberta]
In April 2024, Health Canada issued three (3) notices of violation with a total penalty of $26,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to a registrant of pest control products, Acuity Holdings, Inc. (Edmonton, Alberta). These notices were issued for the distribution of one (1) pest control product not packaged and labelled in accordance with its conditions of registration, manufacture of one (1) unregistered pest control product, and distribution of one (1) unregistered pest control product.
Health Canada has determined that Acuity Holdings, Inc. was distributing a pyrethrin pest control product not packaged and labelled in accordance with its conditions of registration. Health Canada also determined that Acuity Holdings, Inc. did not comply with the product cancellation date stipulated in the Re-Evaluation Decision of pyrethrin by manufacturing a pyrethrin product after its cancellation date and by distributing another product after the last allowable day of sale by a registrant. Distributing a pest control product not packaged in accordance with its conditions of registration, and manufacture and distribution of unregistered pest control products, are violations of the Pest Control Products Act.
Mosquito Man Franchising Corp. was fined $40,000 for using two pest control products in a way that is inconsistent with the directions on the labels, for failing to comply with an order, and for making a false or misleading statement to an inspector regarding the use of a pest control product.
[Windsor, Ontario]
In March 2024, Health Canada issued 4 notices of violation with a total penalty of $40,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Mosquito Man Franchising Corp. (Windsor, ON). These notices were issued for the use of two commercial pest control products in a way that is inconsistent with the directions on the labels, for failing to comply with an order, and for making a false or misleading statement to an inspector regarding the use of a pest control product.
Health Canada determined that Mosquito Man applied insecticides in June 2023, in a way that is inconsistent with the label directions, by not using the required PPE, and by mixing products in a way that is not allowed on the label. Mosquito Man continued to use pest control products in a way that is not specified on the label, after previously receiving an order to cease misuse in 2021. In addition, Mosquito Man gave false information about their use of a pest control product. Use of a product contrary to label instructions, failing to comply with an order, and making a false or misleading statement to an inspector are all violations of the Pest Control Products Act.
Nimby Wildlife & Pest Control Inc. was fined $10,000 for the use of a pest control product in a way that is inconsistent with the directions on the label.
[Milton, Ontario]
In March 2024, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Nimby Wildlife & Pest Control Inc. (Milton, ON). This notice was issued for the use of a restricted class pest control product in a way that is inconsistent with the directions on the label.
Health Canada determined that in December 2022, Nimby Wildlife & Pest Control Inc. applied a pest control product, in a way that is inconsistent with the label directions, by using electric heaters inside a fumigation site. Use of a product contrary to label instructions is a violation of the Pest Control Products Act.
Soderglen South Inc. was fined $10,000 for failing to comply with an order and issued two warnings for use of a product in a way that is inconsistent with label direction and in a way that endangers the environment.
[Cardston, Alberta]
In January 2024, Health Canada issued a notice of violation with a penalty of $10,000 and two notices of violation each with a warning under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Soderglen South Inc. (Cardston, AB). These notices were issued for failing to comply with an order, and for the use of 2% Liquid Strychnine Concentrate (PCP Reg. No. 30433) in a way that is inconsistent with the directions on the label and in a way that endangers the environment.
Health Canada has determined that Soderglen South Inc. failed to comply with an order. Failure to comply with an order is a violation of the Pest Control Products Act. Furthermore, Soderglen South Inc. applied 2% Liquid Strychnine Concentrate (PCP Reg. No. 30433) not in accordance with the labelled directions which posed a risk to the environment. Use of a product contrary to label directions and in a way that endangers the environment are violations of the Pest Control Products Act.
2023
2137483 ONTARIO INC. doing business as MC Mart Inc. was fined $33,000 for distributing two pest control products not registered in Canada and failing to comply with an order.
[Scarborough, Ontario]
In November 2023, Health Canada issued three (3) notices of violation with a total penalty of $33,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to 2137483 ONTARIO INC. doing business as MC Mart Inc. (Scarborough, ON). These notices were issued for the distribution of two (2) unregistered pest control products, and for failing to comply with an order.
Health Canada determined that MC Mart Inc. continued to distribute unregistered pest control products by offering them for sale at their storefront, after previously receiving an order to cease distribution of unregistered products. All pest control products must be registered with Health Canada before they can be distributed or sold in Canada. The unregistered pest control products were a cockroach insecticidal bait powder and a cockroach insecticidal bait pellets. MC Mart Inc. also failed to comply with an order to stop distributing unregistered pest control products. The distribution of an unregistered pest control product and failing to comply with an order are violations of the Pest Control Products Act.
Tooper Pro-LED Lighting Inc. was fined $30 000 for possession and distribution of unregistered pest control products, and for making a false and misleading statement to a Health Canada inspector.
[Scarborough, Ontario]
In November 2023, Health Canada issued three notices of violation with a total penalty of $30,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Tooper Pro-LED Lighting Inc. (Scarborough, Ontario). These notices were issued for the possession and distribution of unregistered pest control products and for making a false or misleading statement to an inspector regarding the distribution and the identity of a pest control product.
Health Canada determined that Tooper Pro-LED Lighting Inc. had in its possession one unregistered pest control product and distributed one unregistered pest control product to another distributor of pest control products. All pest control products must be registered with Health Canada before they can be distributed or sold in Canada. The unregistered pest control products were Greenleaf Powder Cockroach Killing Bait and Green River Cockroach Killing Bait. Tooper Pro-LED Lighting Inc. also made a false and misleading statement to an inspector regarding the distribution of the unregistered product and the identity of a product on an invoice. The possession and distribution of an unregistered pest control product and making a false or misleading statement to an inspector are violations of the Pest Control Products Act.
1701379 Alberta Ltd. doing business as Provincial Pest Control was fined $10,000 for possession of an unregistered pest control product and issued a warning for failing to comply with an order.
[Edmonton, Alberta]
In August 2023, Health Canada issued a notice of violation with a penalty of $10,000 and a notice of violation with a warning under the Agriculture and Agri-Food Administrative Monetary Penalties Act to 1701379 Alberta Ltd. doing business as Provincial Pest Control (Edmonton, AB). These notices were issued for being in possession of an unregistered pest control product and for failing to comply with an order.
Health Canada has determined that, in May 2022, Provincial Pest Control was in possession of a product which is not registered in Canada. Possession of an unregistered pest control product is a violation of the Pest Control Products Act. The unregistered pest control product was a cockroach powder, with no English or French label, and found to contain the active ingredient fipronil, which is not registered in Canada. Furthermore, Provincial Pest Control failed to comply with an order, by the deadline given by Health Canada, to dispose of unregistered pest control products in violation of the Pest Control Products Act. Failure to comply with an order is a violation of the Pest Control Products Act.
Jonair (1988) Ltd. was fined $10,000 for use of an unregistered pest control product.
[Portage La Prairie, Manitoba]
In August 2023, Health Canada issued one notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Jonair (1988) Ltd. (Portage La Prairie, Manitoba). This notice was issued for use of an unregistered pest control product.
Health Canada determined that in August 2022, Jonair (1988) Ltd. conducted an aerial application of a pest control product, which is not registered in Canada. In Canada, use of an unregistered pest control product is a violation of the Pest Control Products Act. The unregistered pest control product used was Wondercide Outdoor Pest Control.
2225686 ONTARIO LTD, carrying on business under the name Darts Import Ltd. or Darts Import, was fined $80 000 for possession and distribution of unregistered pest control products, and for making a misleading statement to an inspector.
[Scarborough, Ontario]
In July 2023, Health Canada issued eight notices of violation with a total penalty of $80,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to 2225686 ONTARIO LTD, carrying on business under the name "Darts Import Ltd." or "Darts Import" (Scarborough, Ontario). These notices were issued for the possession and continued distribution of unregistered pest control products and for making a false or misleading statement to an inspector regarding the identity of a pest control product.
Health Canada has determined that Darts Import had in its possession four unregistered pest control products, and distributed unregistered pest control products at its storefront and to other marketplace stores. All pest control products must be registered with Health Canada before they can be distributed or sold in Canada. The unregistered pest control products were Miraculous Insecticidal Chalk, Greenleaf Powder Cockroach Killing Bait, Dahao Roach Killing Bait and SK Rodenticide. The possession and distribution of an unregistered pest control product and making a false or misleading statement to an inspector are violations of the Pest Control Products Act.
Xavier Zhang was fined $11,000 for importing a pesticide not registered in Canada.
[Markham, Ontario]
In February 2023, Health Canada issued a notice of violation with a total penalty of $11,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Xavier Zhang (Markham, Ontario). The notice was issued for the importation of the pest control product Diquat Water Weed Landscape Herbicide which is not registered in Canada. Importation of unregistered pest control products is a violation of the Pest Control Products Act.
Andrew Belzing was fined $30000 for distributing two unregistered pest control
products and failing to comply with an order.
[Scarborough, Ontario]
In January, 2023, Health Canada issued 3 notices of violation with a total penalty of $30000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Andrew Belzing (Scarborough, ON). These notices were issued for the distribution of two unregistered pest control products and for failing to comply with an order.
Health Canada has determined that Andrew Belzing continued to sell unregistered pest control products on two online marketplace platforms, after previously receiving an order to cease distribution of unregistered products on all on-line platforms in September 2021. All pest control products must be registered with Health Canada before they can be distributed or sold in Canada. The unregistered pest control products were Ninger Cockroach Gel and Bed Bugs Insecticide Powder. Andrew Belzing also failed to comply with an order, by the deadline given by Health Canada, to stop distributing pest control products found to be in violation of the Pest Control Products Act. The distribution of an unregistered pest control product and failing to comply with an order are violations of the Pest Control Products Act.
2022
2137483 ONTARIO INC. doing business as MC Mart Inc. was fined $10,000 for distributing a pest control product not registered in Canada.
[Scarborough, Ontario]
In November 2022, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to 2137483 ONTARIO INC. (of Scarborough, Ontario) doing business as MC Mart Inc. for the distribution of a pest control product not registered in Canada.
Health Canada has determined that in March 2022, 2137483 ONTARIO INC. was distributing Insecticidal Bait Pellets (WP20170105). Distribution of an unregistered pest control product is a violation of the Pest Control Products Act.
Les Arrosages Fertijet inc. was fined $10,000 for using a pest control product in a way that is inconsistent with the label directions
[Saint-Étienne-de-Beauharnois, Québec]
In August 2022, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Les Arrosages Fertijet inc. (Saint-Étienne-de-Beauharnois, Québec).
This notice was issued for the use, in 2021, of a chlorpyrifos-based product in residential settings in a way that is inconsistent with the directions on the label. Use of a product contrary to label instructions is a violation of the Pest Control Products Act.
Les entreprises horticoles C.C.S. inc. was fined $10,000 for using a pest control product not registered in Canada.
[Lévis, Québec]
In April 2022, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Les entreprises horticoles C.C.S. inc., (Lévis, Québec). This notice was issued for the use, in 2021, of MAUGET IMISOL (EPA Reg. No: 7946 21) for treating trees, a product which is not registered in Canada. Use of an unregistered pest control product is a violation of the Pest Control Products Act.
Groupe Verminex inc. was fined $10,000 for using a pest control product in a way that is inconsistent with the label directions.
[Saint-Stanislas, Québec]
In March 2022, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Groupe Verminex inc., (of Saint-Stanislas, Quebec). This notice was issued for the use of a diazinon-based product in a way that is inconsistent with the directions on the label.
Health Canada has determined that the product was applied in residential settings during the 2020 season, in a in a way that is inconsistent with the label directions. Use of a product contrary to label instructions is a violation of the Pest Control Products Act.
2021
Dale Air Services Ltd. was issued a notice of violation with a penalty of $10,000 for use of a registered pest control product in a way that is inconsistent with the directions on the label
[St. Jean Baptiste, Manitoba]
In December 2021, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Dale Air Services Ltd. (of St. Jean Baptiste, Manitoba). This notice was issued for the use of Pounce 385 EC Insecticide (Registration No. 16688 PCP Act) in a way that is inconsistent with the directions on the label.
Health Canada has determined that the product was applied at a campground in July 2020, in a way that is inconsistent with the directions on the label. Use of a product inconsistent with label directions is a violation of the Pest Control Products Act.
John Vanderveen (doing business as WhyKnot A. Farm Ltd.) was fined $10,000 for using a pest control product in a way that is inconsistent with the label directions
[Tappen, BC]
In August 2021, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to John Vanderveen, doing business as WhyKnot A. Farm Ltd. (of Tappen, BC). This notice was issued for the use of Sword Commercial Herbicide (Registration No. 27892 PCP Act) in a way that is inconsistent with label directions.
Health Canada has determined that the product was applied to a barley field in June 2020 using equipment in a manner contrary to the use instructions stated on its label. Use of a product contrary to label directions is a violation of the Pest Control Products Act.
Todd Born was fined $1,300 for using a pest control product in a way that is inconsistent with the label directions
[Sorrento, BC]
In August 2021, Health Canada issued a notice of violation with a penalty of $1,300 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Todd Born (of Sorrento, BC). This notice was issued for the use of Embutox Liquid Herbicide (Registration No. 27912 PCP Act) in a way that is inconsistent with label directions.
Health Canada determined that the product was applied to a barley field in June 2020 using equipment in a manner contrary to the use instructions stated on its label. Use of a pest control product inconsistent with label directions is a violation of the Pest Control Products Act.
Bare Ground Vegetation Services Ltd. was fined $10,000 for using pest control products in a way that is inconsistent with the label directions
[Armstrong, BC]
In July 2021, Health Canada issued a notice of violation with a penalty of $10,000 under the Agriculture and Agri-Food Administrative Monetary Penalties Act to Bare Ground Vegetation Services Ltd. (of Armstrong, BC). This notice was issued for the use of Octtain XL Herbicide (Registration No. 30077 PCP Act) and NuFarm 2,4-D Ester 700 Liquid Herbicide (Registration No. 27820 PCP Act) in a way that is inconsistent with the directions on their respective labels.
Health Canada has determined that the products were applied to twenty acres of weeds in May 2020 using equipment in a manner contrary to the use instructions stated on its label. Use of pest control products inconsistent with label directions is a violation of the Pest Control Products Act.
