Annual report on the Access to Information Act 2019-2020: Women and Gender Equality Canada

Introduction

The Access to Information Act (ATIA) provides Canadian citizens, permanent residents, and individuals and corporations present in Canada a right to access records under the control of government institutions, in accordance with the principles that government information should be available to the public, that necessary exceptions to the right of access should be limited and specific, and that decisions on the disclosure of government information should be reviewed independently of government.

This annual report on the administration of the Access to Information Act describes how the Department for Women and Gender Equality (WAGE) fulfilled its responsibilities under the Access to Information Act during the reporting period of April 1, 2019 to March 31, 2020.

The Minister for Women and Gender Equality and Rural Economic Development, as head of the Department of Women and Gender Equality, is required to prepare an annual report on the administration of the Act. This report is prepared and tabled in Parliament in accordance with section 94 of the Access to Information Act. Furthermore, pursuant to Standing Order 32(1) and the provision of section 20 of the Service Fees Act all fees collected be stated in the Statistical Report.

Women and Gender Equality Canada mandate

The mandate of Women and Gender Equality Canada is to advance equality with respect to sex, sexual orientation, and gender identity or expression through the inclusion of people of all genders, including women, in Canada's economic, social, and political life. This application of a gender and diversity lens will help us to better understand the intersection of sex and gender with other identity factors. These factors include, but are not limited to, race, national and ethnic origin, Indigenous origin or identity, age, sexual orientation, socio-economic condition, place of residence and disability.

The vision of WAGE is a Canada where people of all genders, including women, are equal in every way and can achieve their full potential.

WAGE works to advance gender equality through an intersectional gendered lens. Working in partnership with key stakeholders, including civil society organizations, labour groups, the private sector, other orders of government, and First Nations, Inuit and Métis peoples, WAGE actively promotes the inclusion of all people in Canada's economic, social, and political life. WAGE works to uphold its mandate to advance gender equality by performing a central coordination function within the Government of Canada by developing and implementing policies, providing grants and contributions, delivering programs, investing in research, and providing advice to achieve equality for people of all genders, including women.

Organizational structure

The Access to Information and Privacy (ATIP) office is part of the Corporate Secretariat. This office is responsible for implementing and managing programs and services relating to WAGE's administration of the Access to Information Act and the Privacy Act, as well as providing advice to WAGE's employees as they fulfill their obligations under both acts. The ATIP office coordinates all activities related to the legislation within the Department both at headquarters and in the regions.

In fiscal year 2019-2020, the ATIP office consisted of an ATIP Manager, ATIP Coordinator supported by ATIP officers at various levels. The ATIP Office employed a total of two (2) full-time equivalents and one casual employee.

The ATIP Manager and ATIP Coordinator acts on behalf of the Minister for Women and Gender Equality and Rural Economic Development, to ensure that the Department's responsibilities under the Access to Information Act, the Privacy Act and the Service Fees Act are met. The ATIP Manager/ATIP Coordinator reports to the Corporate Secretary, Corporate Secretariat. There were 2 areas of responsibility, which included the following key activities:

The Minister of Women and Gender Equality and Rural Economic Development (formerly the Minister of Status of Women), has given the responsibilities associated with the administration of the Access to Information Act to the Department of Women and Gender Equality (WAGE) officials through a delegation order (Appendix B).

Performance 2019-2020

The Access to Information and Privacy Office (ATIP) received forty (40) new requests, closed fifty-two (52) requests, and carried over five (5) requests; completed thirty-five (35) consultations with other government of Canada institutions, and completed one (1) consultation with another Canadian organization during 2019-2020; and processed five (5) Notices of Release from other government of Canada institutions. The ATIP office processed 1,259 pages during 2019-2020; responded to eighty-one (81) calls for information from internal and external clients; and, responded to nine (9) parliamentary questions related to ATIP.

Cost of operating the program amounts to $174,882.00 for fiscal year 2019-2020.

Interpretation of the statistics for requests under the Access to Information Act

The annual statistical report for fiscal year 2019-2020 is included at the end of this chapter (Appendix A). An additional Supplemental Statistical Report, Requests affected by COVID-19 measures table is included under section 11 and as Appendix C of this report in accordance with a new policy from Treasury Board Secretariat of Canada. The new report identifies the impact of COVID-19 measures on Women and Gender Equality Canada's (WAGE) performance for 2019-2020 for transparency purposes.

Requests under the Access to Information Act

Number of requests

Between April 1, 2019 and March 31, 2020, WAGE received forty (40) new requests and carried over seventeen (17) requests from the previous year which were mostly received during the month of March 2019. In addition, the ATIP program received thirty-five (35) consultations requests for consultation from other federal institutions and one (1) consultation from a Canadian organization and processed five (5) Notices of Release from other federal institutions of Canada.

During the fiscal year 2019-2020, Media was the largest group of requesters, followed by the Public, Organizations, and Academia. No requests were receive providing identification for Business (Private Sector) nor declined to identify.

The time limits were extended for twenty-four (24) requests; they were extended due to interference with the operations of the department, or external consultations with other government institutions and third party notices, although internal consultations were also contributing factors.

Method of access

Access to the relevant documents was given in whole or in part for forty-five (45) requests. Paper copies were provided in two (2) cases and in an electronic format in forty-three (43) cases.

Fees

Net fees collected amounted to $95.00 and represent 19 requests with application fees. The fees waived amounted to $165 and represent 33 requests. These are due to requests with multiple briefing notes and other requests which had several different types of information of interest in the same request.

Reporting on access to information fees for the purpose of the Service Fees Act

The Service Fees Act requires a responsible authority to report annually to Parliament on the fees collected by the institution.

With respect to fees collected under the Access to Information Act, the following information is reported in accordance with the requirements of section 20 of the Service Fees Act.

In accordance with the Interim Directive on the Administration of the Access to Information Act, issued on May 5, 2016, and the changes to the Access to Information Act that came into force on June 21, 2019, WAGE waived some fees prescribed by the Act and Regulations, other than the $5 application fee set out in paragraph 7(1)(a) of the Regulations.

Cost of operating the program for fiscal year 2019-2020: $174,882.

Training and awareness

One (1) formal training activity was provided during the reporting period. Seventy seven (77) requests for advice and guidance were provided during the fiscal year to internal and/or external clients.

Policies, guidelines, procedures and initiatives

The Department recognizes recent challenges in meeting deadlines pertaining to requests made under the Access to Information during the 2019-2020 fiscal period. WAGE has taken steps to address this issue by developing and implementing clear processes and timelines for ATIP requests; hiring additional ATIP officials to increase the capacity of the ATIP team; and offering additional training to other WAGE officials to facilitate and expedite the Department's ATIP responses.

Summary of key issues and action taken on complaints or audits

Applicants have the right to register a complaint with the Office of the Information Commissioner (OIC) regarding any matter relating to the processing of their requests.

The Department received no complaints during fiscal year 2019-2020.

No audits relating to the administration of ATIP legislation were concluded during the reporting period.

Monitoring compliance

A status report of all requests is prepared on a weekly basis for the review and oversight by the Corporate Secretary, and to WAGE's senior management.

Supplemental statistical report on the impact of COVID-19 on the Access to Information Act

In addition to completing the forms for the Statistical Report on the Access to Information Act for 2019-20, institutions were asked to complete a Supplemental Report to help identify the impact of COVID-19 measures on institutional performance for 2019-20 and going forward.

The Department received under the requiring reporting forty (40) requests during the period of 2019-04-01 to 2020-03-13 and no requests were received during the period of 2020-03-14 to 2020-03-31 under the Access to Information Act for 2019-2020.

From the number of requests received from 2019-04-01 to 2020-03-13 and outstanding from previous reporting periods, thirty-sever (37) requests were closed within the legislated timelines and fifteen (15) requests were closed past the legislated timelines and no requests were received during the period of 2020-03-14 to 2020-03-31 under the Access to Information Act for 2019-2020.

There were five (5) requests received from 2019-04-01 to 2020-03-13 and outstanding from previous reporting period that were carried over to the 2020-2021 reporting period and no requests received from 2020-03-14 to 2020-03-31 were carried over to the 2020-2021 reporting period.
