The Treasury Board is the employer of this segment of the federal public service. Separate agencies are named in Schedule V of the Act. - Termination definitions:
- Discharge for misconduct: The end of employment as a result of breaches of discipline or misconduct. It is generally due to wilful action or inaction on the part of an employee that breaches any applicable policy, rule, standard or code governing conduct that is either explicit or implicit.
- Released for incompetence or incapacity: The end of employment because the employee does not perform the duties of their position at the acceptable level of performance despite efforts to provide training, mentoring and coaching or the end of employment for other reasons, such as medical incapacity where the employee is absent due to illness or disability that prevents the employee from fulfilling their employment obligations.
- Termination on probation: The end of employment during the probationary period, normally 12 months when appointed/hired from outside the public service. Rejection during probation must be for an employment-related reason.
- Layoff includes the end of surplus period.
- Other separations include resignations (outside employment, personal reasons, return to school), resignations under the WFA program, death, etc.
