Description of the objective
Issue
Regulations under the Public Service Employment Act establishing periods of probation and periods of notice of termination of employment during probation. The current regulations have a provision regarding persons with disabilities that states “The probationary period for an employee who is disabled and requires job accommodation begins on the day on which the necessary accommodation is made.” The duty to accommodate provision is too restrictive.
Description of the regulation
Change the provisions related to duty to accommodate to reflect jurisprudence “The probationary period for an employee who requires job accommodation begins on the day on which the necessary accommodation is made.”
