On January 27, 1993, safety officer Diana Smith gave a written direction, under subsection 145(1) of the Canada Labour Code, Part II, to Vancouver Wharves Ltd. respecting the provision of clean towels for taking a shower. The direction was issued for non compliance with paragraph 125(g) of the Code and subsection 9.23(10) of the Canada Occupational Safety and Health Regulations.
An extension of time to file submissions was granted to Vancouver Wharves Ltd. representatives to discuss the above issue with the safety officer. The discussions led to the resolution of the issue in the interest of employee safety and health. In view of this situation, Vancouver Wharves Ltd. withdrew, on May 6, 1993, its request to have the direction reviewed. Accordingly, I find I am no longer seized of this matter. I declare this file closed.
