The grievor complained that he had been denied the Real Estate Incentive (REI) after electing not to sell his home on posting. The Committee found that the grievor did not make the election until three months after he received the appraisal on the home and, in accordance with the Canadian Forces Integrated Relocation Program directive, he was required to make the election within 15 working-days. Consequently, the Committee found that the grievor was not entitled to REI and recommended that the Final Authority (FA) not afford the grievor redress.

The FA agreed with the Committee's finding that the grievor was not eligible for the REI benefit and the Committee's recommendation to deny redress. The FA also agreed that the Treasury Board (TB) should be engaged with a view to developing a more flexible timeline for the benefit and noted that discussions with TB were ongoing.
