The grievor grieved his release under item 5(f) - Service Completed - Unsuitable for Further Service, of the table to article 15.01 of the Queen's Regulations and Orders for the Canadian Forces. The grievor also grieved that the administrative review did not meet the minimum standards of procedural fairness.

The Director General Military Careers, acting as the Initial Authority (IA), found that the administrative review was procedurally fair. The IA concluded that the grievor's release under item 5(f) was appropriate and did not afford the grievor redress.

The Committee found that the grievor's role in an incident amounted to misconduct and breached several policies.

The Committee also found that the grievor's release was justified and item 5(f) was the most appropriate release item.

In addition, the Committee found that the grievor's right to procedural fairness was respected in the administrative review process and the release decision.

The Committee recommended that the Final Authority not afford the grievor redress.
