The grievor disagreed with the assignment of his permanent medical category (PCat) and his removal from training. More specifically, he argued that the PCat was premature and that he was not given a chance to resolve his medical issues. Furthermore, he argued that the Wing Surgeon (W Surg) did not provide him with proper medical assistance. The grievor sought to be returned to his training.
The Initial Authority (IA), the Commander Canadian Forces Health Services Group, denied the grievance, finding that the Canadian Armed Forces (CAF) medical subject matter experts had conducted a thorough review of the grievor's medical file and confirmed that the assigned PCat and the Medical Employment Limitations (MEL) were reasonable, justified and in accordance with policy. As such, the IA concluded that the PCat and MEL should remain unchanged.
The Committee found that several medical specialists had reviewed the grievor's medical condition and their opinions were consistent; the PCat and MEL were justified. Therefore, the Committee concluded that the decision to assign the grievor a PCat and remove him from training was reasonable and consistent with the CAF policy.
Finally, the Committee found no evidence to conclude that the W Surg had failed to provide the grievor with proper medical treatment. To the contrary, the Committee noted that as soon as the grievor disclosed his issues, he was given access to professional medical care, including various other medical specialists.
The Committee recommended that redress not be granted.
