The grievor sought to be compensated for the loss of employment caused by the delay in the start of his Class “B” Reserve Service.
The Board noted that the grievor had submitted his application to his unit Chief Clerk three days before the closing date. However, the grievor's application could not be processed as the Chief Clerk was out of the office and did not receive it until after returning to the unit two days after the application deadline. As the closing date had already passed by the time the grievor's application was forwarded to the Brigade Headquarters, the competition had been automatically extended.
The Board noted that, in accordance with article 4.10 of Canadian Forces Military Personnel Instruction 20/04, Class B Reserve Service cannot commence until an authority document has been issued. In this case, no such document had been issued for the original start date. Accordingly, although the delay was unfortunate, the Board found that the grievor was not entitled to Class B Reserve Service pay and benefits for the period of the delay.
The Board recommended that the grievance be denied.
