The purpose of this Regulatory Directive is to exempt selected swimming pool and spa chemical products from registration as per section 5(c) of the Pest Control Products Regulations.

This Regulatory Directive replaces Memorandum to Registrants R92-01.

Background Information

Scheduling allows a reduction in paper burden for both industry and government while at the same time allowing a degree of control of products being marketed. It does, however, place greater responsibility on industry to ensure that products marketed meet certain basic standards.

Section 5(1)(c)(i) of the Regulations allows exemption from registration of specific kinds and types of products, provided they meet all the applicable conditions set out in Schedule II of the Pest Control Products Regulations.

Products which meet the conditions of Schedule II of the Regulations remain under the authority of the Pest Control Products Act and are subject to routine sampling and enforcement programs. However, provided they comply with all the terms and conditions set out in Schedule II, they are exempt from the registration process including documentation and renewals.

Products

The amendment to the Regulations will schedule approximately 500 selected Domestic Class products currently registered for the control of bacteria and/or algae, in residential swimming pools and spas. Any additional products, marketed after the publication of this Regulatory Directive, which meet the conditions outlined below will also be subject to Schedule II.

Products that contain concentrations, mixtures or active ingredients other than those listed in the schedule, and commercial class/category products will be subject to the normal registration review process. See Regulatory Directive Dir93-06 for conditions and model labels.

Terms and Conditions of the Schedule

To be subject to scheduling, rather than registration, products must meet the following conditions:

1. The product is represented or sold as a domestic class swimming pool or spa product to control bacteria and/or algae. All sources of the technical active ingredient used in the product must be registered under the Pest Control Products Act and Regulations. The active ingredients must be listed in item 5 of this Regulatory Directive.
2. Appropriate contents, use instructions, limitations, precautionary statements and hazard symbols must appear on the product label; and
3. Prescribed limitations on the concentration of registered active ingredient and the amount of available chlorine content must be followed.

Active Ingredients

Considerations

1. The amendment to Schedule II meets the requirements of the Pest Control Products Act for safe and functional products based on familiarity with these formulation types and many years of registration experience with these products;
2. This amendment reduces administrative costs for industry and the federal government;
3. The amendment provides a continuing regulatory control mechanism based on the requirement for registration of the technical active ingredient in these formulations, and does not remove the authority for enforcement of other sections of the Pest Control Products Regulations;
4. This change provides the consumer with increased opportunity for a less complicated choice in the marketplace through standardized label claims regarding product performance;
5. The amendment does not expand the use pattern for these active ingredients.

The following information must be provided on the label

1. The principal display panel of the label must contain:
   1. the function of the product;
   2. the information referred to in Schedule II of the Regulations in the Table following Section 9; items 1, 2, and 3 must be set out as guarantee statement in the following manner
      1. the word "Guarantee" in upper case letters followed by
      2. a colon, followed by
      3. the common name of the active ingredient of the control product as set out in CSA Standard Z143-1980, Common Names for Pest Control Chemicals, dated January 1980, or, where no common name for the ingredient is set out in that Standard, the chemical or other name of that ingredient, followed by
      4. the contents of the active ingredient expressed
         • in the case of a control product that is. liquid, as a percentage by mass or as mass per unit volume, or both, or
         • in the case of a control product that is a dust, a wettable powder or other dry formulation, as a percentage by mass;
   3. Hazard statements and warnings including:
      1. the appropriate precautionary symbols according to the attached model labels (primary hazard superimposed on the degree of hazard (as illustrated in Schedule III of the Regulations);
      2. the appropriate signal words as determined by the attached model labels;
      3. a statement respecting the nature of the primary hazard to which the symbol relates.
   4. A declaration of net quantity of the control product in the package expressed
      1. by volume, in the case of a control product that is a liquid or gas or is viscous, or
      2. by mass, in the case of a control product that is solid or pressure-packed.
   5. The name and postal address of the Canadian agent or distributor.
   6. The statement, "Scheduled Under the Pest Control Products Act". Do not use the original Pest Control Products Registration Number.
2. The secondary display panel of the label must contain:
   1. Instructions for disposal of the control product and its empty packages as per the attached model labels;
   2. the information referred to in the Table to Section 9, items 4, 5, 6 and 7, Schedule II of the Regulations as follows:
      1. The direction for the use of the control products including dosage rates, time of application and use limitation.
      2. Information identifying any hazards respecting the handling, storage, display, distribution and disposal of the control products, including instructions respecting procedures to alleviate the hazards.
      3. Information identifying any hazards to
         • things on, or in relation to which, the control product is intended to be used; and
         • public health, plants, animals or the environment.
      4. Instructions respecting procedures to alleviate the hazards referred to in paragraphs (iii) above.
      5. Instructions in first aid, under the heading "First Aid Instructions" in upper case letters setting out the practical measures to be taken in the event of poisoning, intoxication or injury caused by the control product.

The registrant will find the Model Labels for Pool and Spa Chemicals (attached) useful in preparing the labels. For the use and concentration of active ingredients described in this schedule, the registrant can use the Model Labels by inserting their company's relevant information (i.e., address, etc.).

Procedures

1. The scheduling of these pool and spa products is expected to take effect in early 1993.
2. Products that are currently registered must comply with Schedule II criteria in order to be scheduled. These products will retain their registration status until 31 December 1995; so that old stock bearing the registered label can be used. New labels will carry the message "Scheduled Under the Pest Control Products Act" instead of the original PCP registration number.
3. New labels can be used for the 1993 season.
4. Registrants of the technical active ingredients are requested to inform clients of the new conditions which are set out in Schedule II of the PCP Regulations.

Initially superchlorinate pool water by adding to the pool 1 L of [Pool Sanitizer-1] per 10,000 L of pool water. For best results superchlorinate at dusk.

Chlorinate daily to maintain proper chlorine residual with 250 mL of [Pool Sanitizer-1] per 10,000 L of pool water, or as needed.

Note: Hot weather, heavy pool usage, and rain may require higher usage rates to maintain proper chlorine residuals.

Superchlorinate weekly with 1 L of [Pool Sanitizer-1] per 10,000 L of pool water when average daily temperature is 25°C - 32°C. Otherwise, superchlorinate every other week.

For visible algae, superchlorinate using 2 L of [Pool Sanitizer-1] per 10,000 L of pool water. Heavy algae infestation may require dosages up to 3 L per 10,000 L. Vacuum pool when dead algae settles.

For wading pools, chlorinate daily to maintain a chlorine residual of 3-5 ppm by adding 45 mL of [Pool Sanitizer-1] per 1000 L of pool water, or as needed.

Initially, superchlorinate pool water with 150 g of [Pool Sanitizer-2] per 10,000 L of pool water. For best results, superchlorinate at dusk.

Maintain proper chlorine residual by broadcasting daily over the pool's surface, 30 g of [Pool Sanitizer-2] per 10,000 L of pool water, or as needed.

Note: Hot weather, heavy pool usage, and rain may require higher usage rates to maintain proper chlorine residuals.

For outdoor pools, chlorine residuals can be protected from destruction by the sun's rays by adding 300 g of stabilizer [cyanuric acid] per 10,000 L of pool water to yield the required initial concentration of 30 ppm.

If using an automatic chlorinator, fill the chamber[s] with tablets and adjust flow rate, according to manufacturer's recommendations, to maintain proper chlorine residual. Adding tablets to the pool's skimmer basket is an alternative chlorine feed method. Daily usage should approximate 25 g of [Pool Sanitizer-5] per 10,000 L of pool water.

Note: Hot weather, heavy pool usage, and rain may require higher usage rates to maintain proper chlorine residuals.

Periodic superchlorination of pool water is recommended. Follow label instructions of superchlorination product being employed.

[Pool Sanitizer-5] contains stabilizer which can accumulate in pool water. Keep stabilizer within the range of 30 - 100 ppm by dilution with fresh water.

Periodic superchlorination of pool water is recommended. Follow label instructions of superchlorination product employed.

[Pool Sanitizer-6] contains stabilizer which can accumulate in pool water. Keep stabilizer within the range of 30 -100 ppm by dilution with fresh water.

While [Pool Sanitizer-6] can be used for superchlorination, using 180 g per 10,000 L of pool water, care must be taken to avoid excessive accumulation of stabilizer.

Superchlorinate a freshly filled spa by adding 35 g of [Spa Sanitizer-1] per 1000 L of spa water. Maintain water circulation at least 15 minutes before using. Repeat superchlorination procedure after each use period.
